Questions about privacy and personal data
At the start of an employee, as a client, you are required to verify the identity based on the original identity document. This check may not be conducted based on a copy of the document. This obligation arises from the NEN 4400-1 standard, the Wage Tax Act, and the agreements between you and Timing.
By performing this check, you help prevent fraud, identity swapping, and illegal employment.
Timing meets the requirements of the NEN 4400-1 standard, the verification obligation, and the SNA quality mark. This allows us to check identity documents for authenticity and validity and ensure that employees are indeed the person they claim to be.
This approach protects both clients and Timing against fraud, illegal employment, and the associated risks.
Our legal advisor explains why this is so important:
For example, by scanning copies of an identity document, there is a high risk that a person who is not allowed to stay in the Netherlands and/or perform work is employed. In the case of illegal employment, even if only for a few hours, the client can face a fine of € 10,000.
With repeated violations, these fines increase further and can even double or triple. Additionally, violations are made public. This exposes both Timing and the client to reputational damage.
Timing also faces an investigation by the Inspectorate SZW with each case of illegal employment. This takes time and incurs additional costs. Incidents are also reported to SNA/VRO, which can lead to further investigations and ultimately even affect our certifications.
Timing processes personal data in accordance with the rules of the General Data Protection Regulation (GDPR). In doing so, we take appropriate measures to protect personal data and do everything we can to prevent data breaches.
We handle the collection, storage, and sharing of personal data carefully and expect the same from our clients.
A data breach occurs when personal data ends up with someone who should not have access to it. This risk arises, for example, when copies of identity documents are stored or shared insecurely.
Common situations are:
- Photographing an identity document with a smartphone.
- Storing a copy on a computer.
- Sending identity documents via email.
- Sharing documents via WhatsApp.
- Storing files in personal cloud environments.
- Making copies via printers or copiers with internal memory.
Because personal data often remains unintentionally stored in these ways, these are undesirable situations under the GDPR.
Sending identity documents through unsecured channels carries risks. Documents can be stored on devices, in mailboxes, photo galleries, or cloud environments without this being immediately visible.
To protect the privacy of employees and comply with the GDPR, Timing opts for a careful and secure processing of personal data.
When someone is put to work who is not allowed to reside or work in the Netherlands, this can lead to high fines. For clients, a first offense can already cost thousands of euros. In addition, violations can lead to reputational damage, extra inspections by regulators, and risks for certifications within the temporary employment sector.
That is why both Timing and clients take identity checks very seriously.
Timing operates according to the guidelines of:
- The verification obligation
- The NEN 4400-1 standard
- The SNA quality mark
- The General Data Protection Regulation (GDPR)
These rules help to carefully process personal data and prevent fraud, abuse, and illegality.
